You are very right on that. It’s just that from my point of view, right now, they’re having fun doing it. But I completely agree with you on the spirit of the matter.

I’ve got a bit of an etiquette conundrum on my hands… first of all – MAP! (Thanks in large part to the Rei’s Minimap mod)
To establish some of the background information; my tower and the four supporting pylons (circled in purple) have been erected for a few weeks now. The central tower may not have had its current top, but all 5 structures are big, obsidian, and at least 150 meters high. Hard to miss is what I’m getting at.
Less than a week ago a cobblestone structure appeared within the pink circle. While not much to look at above ground, I assure you they have built a nice little underground thing. Overall I’m not TOO bothered by this proximity – kinda gives the feeling of a god residing over the tiny tiny mortals (MUAHAHAHAAHAHA *Cough cough*). However these tiny m— er, two users, have now included a nether portal in their shelter. Right about where the red arrow is in the center of the map. There was some building going on on the nether side, but the portal did not correctly connect back so I have no idea if their portal connected to an existing one in the nether, or they were the ones who built the stuff in the nether. In either case, I erected a new properly connecting gate for them and built a road to the location their gate used to connect.
That is not the issue, however. As their portal now overrides any I could ever build inside my tower. Even building a portal at the furthest possible point in my tower, and activating a portal in the nether at the ideal coordinates – both invariably connect to theirs. Coles Notes version – I can’t build a nether portal in my tower because their portal is too close.

My opinion — you can’t really do anything.
It sucks when someone builds a portal too close — near my base, someone built JUST a portal apparently intended as a door to the future site of something, but never got around to making the something. So I can never build a portal in my base without having it link to them, even though it is just a fancy portal with nothing else.

I am still of the oppinion that you can keep them out on account of having built within the radius of such a large and dominating structure. After all, they REALLY should have known better then to build there. And honestly this is basically just you saying you need to shut down their Nether Portal anyway. I think that’s pretty reasonable, really.

I think a similar thing to this came up with Trench, actually. If you’re going to put a Nether Portal above the height limit, it need to actually be all the way up there in the nether, otherwise it tends to not connect properly.
Or at least that is how I understand it. I could be mistaken.
